Price Match
A Price Match can be requested by emailing us through our 'Price Match Request' page and completing a simple form. The request will be reviewed within 48 hours and the results communicated by email. If we are able to offer a reduced price it will be shown in your cart the next time you login. You then have 24 hours to complete the purchase before the reduced price expires. The price match product must be identical, in stock, not clearance or special offer, and must include the cost of a comparable delivery service.
​We are unable to process price match requests after purchases have been made.
Please note we do not price match against eBay or other auctions sites or third party sites, and we reserve the right to refuse a price match request.

Descriptions, prices and product information

We aim to show items as accurately as possible, but they may look different in the flesh. We take great care to reproduce item descriptions and specifications provided by manufacturers accurately, but occasionally we make mistakes. If there is anything which is unclear, or if you wish to obtain further information, please contact us by email or call 01903 .


From time to time prices of items published on our website may differ from the price offered at the same time in store.

All prices are shown inclusive of any VAT (where applicable). The price of each item does not include the cost of delivery or any other services. We reserve the right, however, to change prices on our websites at any time without notice to you. We make every effort to ensure that prices shown are accurate when you place your order.
 

Eligibility & Availability

Eligibility to Order

To be eligible to purchase items from Aqua-Fish.co.uk, you must be (a) be 18 years of age or over; and (b) have a credit or debit card acceptable to us in your name and (c) stipulate a delivery address within the UK (d) and give your real name, address, phone number, email address and any other details requested.

We reserve the right to decline a new customer registration or suspend your account at any time.

We also reserve the right not to accept your order for any reason.
 

Availability

We try our best to ensure that all items on our site are clearly shown wether they are in stock or out of stock. If an item is available an 'Add To Cart' button will be shown, If an item is unavailable or is a 'collection from store only' product then the 'Add To Cart' button will not be shown on the item. If, for any other reason beyond our control, we are unable to supply a particular product, we will not be liable to you except to ensure that you are not charged for that product. Some items are not held in stock and these therefore will have a longer delivery time.

We will let you know as soon as possible if any particular item is unavailable for purchase.

To ensure availability of all our items, we may place restrictions on how many units of a particular product you can order at a time. We reserve the right to withdraw any product from sale for any reason.

Due to the size of our catalogue some items can become unavailable or discontinued; in this case we will contact you immediately to ask you how you would like to proceed.

Payment

We only accept payment in Pound Sterling and by credit or debit card.

We are able to accept PayPal, MasterCard, Visa, Maestro, Delta, Solo, Visa Electron, although we reserve the right to refuse to accept any of these cards from time to time without notice. We try hard to ensure that using your credit or debit card when you shop online is safe and secure. Our secure server encrypts your credit card number details and your personal information before securely transmitting them. Your browser will show you are in a secure environment by showing either a locked padlock or an image of a key in the grey bar at the bottom of the page; it may let you know that you are entering secure mode as you go to place your order.

When you have made your choice and your order has been placed, you will receive an order confirmation email acknowledging the details of your order. This email is not an acceptance of your order, just confirmation that we have received it.

The contract between us for the items you have ordered will only be formed when we email you to confirm that the items have been dispatched. The contract will therefore be formed in England and the language of the contract will be English.

Payment will be debited from your account upon submission of your order online. This will not be when the contract between Aqua-Fish and you is formed (see above).

All refund payments will be paid to you in Pound Sterling and will match the amount you paid in Pound Sterling for the item(s) and delivery (if the delivery charge is refundable).

Local Delivery Service

We currently offer local delivery on some items, please phone us on 01903 756636 where we will notify you on dates/times of delivery. Please ensure someone over the age of 16 is available to accept your order at the address provided as all orders will need to be signed for.


Delivery

Delivery to your home or chosen address may incur a charge as detailed in our Delivery Information section. The delivery charge is charged on your total order.

Once items have been dispatched delivery address can not be changed.

We aim to deliver the majority of items that we have for you within 5-7 working days for most UK postcodes. For remote UK postcodes and locations not classified as mainland UK then we will aim to deliver items to you within 7-10 working days after you have placed your order. On certain items there is a longer lead time which is up to 28 days. Like all internet retailers we rely on commercial carriers. We give an estimated delivery date but are not able to guarentee a delivery date and time. For orders that are delivered direct to you by our suppliers, after placing your order they will contact you to arrange a delivery date that is convenient to you. 

Dispatch times quoted are subject to stock availability.

For orders that are using the Collect From Store option we advise you contact us to check the item(s) you want to order are in stock or for information when they will be ready to collect. When your order is ready for collection from the store we will email you providing you have supplied these contact details when ordering. When collecting your order from store please take along your order confirmation email and the payment card you used to place the order, a valid form of ID which proves you are over 18. Please ensure the name on your ID matches the name provided when ordering. 
We carry out a thorough inspection of your item(s) with you at the time of collection to ensure you are totally satisfied.

Aquariums and some products are listed as Collection and Payment in store only.

A signature may sometimes be required at delivery. By placing an order you are authorising us to accept signature from another person at the same address on your behalf if you need to sign for an item and you are not present at the time of delivery.

For some items that do not require a signature at delivery you may be able to give instructions explaining if and where you would like the product to be left if no one is present at the time of delivery, such as with a neighbour.

Ownership of an item will not pass to you until the product has been delivered to you (either directly, or by leaving it in a safe place or with a neighbour or where you have signed for it when using the collect from store option). Once an item is delivered, responsibility for risk of damage to or loss of the product passes to you.

We also use third party delivery companies which may, at their discretion, leave an item in a safe place if no one is present at the time of delivery. In these circumstances the delivery company will put a card through your letter box explaining where the product has been left.

Should your order include a large item, e.g.,'an Aquarium' it is your responsibility to ensure you check access to your premises before placing your order.

We will send you an email when your order has been dispatched and this will include a tracking number if available.

We cannot accept responsibility for delivery delays due to third party couriers and delivery charges will not be refunded on any occasion.



Delivery Charges

Delivery is charged at £4.95. We reserve the right to change delivery costs without prior notice. If prices change we will contact you before sending out your item(s). 

AquaFish delivers orders to Mainland UK only. Some postcodes including Northern Scotland, Northern Ireland, Isle Of Man and the Isle Of Wight are subject to an additional handling charge by our carriers which we have to pass on.

Estimated delivery charges are shown in the shopping cart. 


If the courier is unable to deliver your order, your order may be held at their local depot for your collection. If in the event you do not collect your order the item(s) will be returned to our warehouse. The courier will charge us to return the order to our warehouse and we have no choice but to pass on this charge. If you require your order to be dispatched again the full delivery cost will be payable.

Collecting from Aqua Fish Store is FREE.



Cancellations, Returns & Refunds

Cancelling an order - Due to change of mind prior to or at the time of delivery

If the product(s) has not been despatched we will cancel the order and the full price paid will be refunded.

Your right to cancel an order starts the moment you place your order and doesn't end until 7 working days from the day after you receive your goods.

If you wish to cancel any orders then please send a confirmation email to us at info@aqua-fish.co.uk within 7 working days from receiving your goods. We must recieve the goods within 21 days of the notice of cancellation during which time you are responsible for any loss or damage. Once received in New, Unopened and Unused condition we will refund the purchase price 

If you cancel an order due for collecting in store you do not need to come in to store to refuse the item. The order will be cancelled and the price paid for the item will be refunded (if paid for online). 

Please note that your right to cancel and return an item does not apply to certain items unless these items are damaged, faulty or mis-described. Such items include: perishable and other item(s) that deteriate rapidly such as Aquatic Plants, Livefoods, Livestock, Frozen Foods and Bespoke Items.

Your rights under UK consumer legislation for these items are not affected.



Returns

You can return your item(s) to any AquaFish store along with the delivery note you received in your parcel and the Debit / Credit card which you used to buy the items; or

You can post the item(s) together with the delivery note which you received in your parcel to AQUA FISH , indicating which item(s) you are returning.

If you are posting an item back to us we recommend that you obtain a proof of posting certificate or receipt.

You will be responsible for the cost of returning the items which are not damaged, faulty or mis-described, subject to any rights you have under UK or your national consumer legislation.

You must take reasonable care of the items whilst they are in your possession. If you do not exercise reasonable care and the items are damaged whilst in your possession or in transit we will not be able to accept the items. We therefore recommend that when you return the item(s) you use a postal service which insures you for the value of the item(s) you are returning.

When you return your items please return your item(s) unopened, undamaged, in a saleable condition, and with all of its components, including the original packaging.
If item(s) arrive back in any less than perfect condition they will returned to you and no refund will be processed.

Where you have chosen the collect from store option, if you fail to collect your item within 7 working days of being notified that the item(s ) is ready for collection, then your order will be cancelled.

Return of damaged, faulty or mis-described items

When your items are delivered please check that the order is complete and not damaged. In the event that your order is visibly damaged, do not accept the order and enter on the Returns Form or delivery note "Damaged" along with a brief description of how or where the item is damaged.

Please note that for courier companies to accept liability for damage caused in transit we must inform them of any damage within 24 hours of delivery. Therefore, you should inform us as soon as possible following delivery of the item(s). Any claims made after this time but within 5 days will be subject to our discretion and thereafter any such claims may be considered unreasonable.

If you have accepted the item(s) and subsequently discover that they are damaged/ faulty/mis-described or parts are missing, you may be entitled to a refund, replacement or repair. Where a replacement/repair is not possible e.g. because the product/parts no longer exist then a refund will be offered.

If faulty item(s) are received you must notify us within 7 working days. Where possible replacement parts will be dispatched and where not possible we will ask you to return the goods to us inline with our returns policy.

Do not continue to use your item once you have discovered a fault. As soon as you detect that your item is faulty, please return the item to us indicating on the Delivery Note what the issue is. Please return the item with all of its components, including the original packaging, where possible.

Aqua Fish work with the manufactures to ensure their guarantees are honoured and we use best endeavours to resolve issues within the warranty period. We can only refund postage costs under the manufactures guarantee if the goods are returned to us within 28 days of the original purchase. We can only offer replacements parts or replacement goods when authorised by the manufacture. Under no circumstances should goods be returned to us without prior approval. 


Products that carry a manufacturer's guarantee can be returned, if faulty, to us for exchange during the warranty period. All products still in guarantee will be tested upon return.

For presumed faulty goods, if after testing your product is found to be non-faulty, a charge will be payable to cover collection and redelivery before your goods can be returned.

Aqua Fish process returns as quickly as possible. Returns are typically handled within 7 working days, but it may take longer if testing is required to confirm the presence of a fault.


Electrical Equipment
Please be aware that aquarium pumps, filters, skimmers and other electrical goods emit noise during normal operation that you may consider to be excessive. You should be aware that manufacturers wording indicating noise levels are relative only and do not necessarily give indications of measured decibel levels. Return of good under these circumstances requires the agreement of the manufacturer and where goods returned are deemed to be in good working order by the manufacturer we are unable to offer a refund and may charge return postage. Aqua Fish withhold the right to repair any electrical goods and a replacement will only be issued if the manufacturer or UK distributor decides this is necessary. Customers may be asked to return items to us for repair or replacement, we cannot be held accountable for collecting faulty goods.

In common with all aquatic retailers we cannot accept claims for damages once you and Aqua Fish have inspected and checked your glass aquarium in store. It is therefore essential that you are satisfied that your aquarium is in good condition at the time you take your item(s) out of Aqua Fish store.

Refund Policy

Please note that refunds can take up to 20 days to appear in your in your bank or credit card account. This may depend on which bank you use and where it is located. We will make any refund payment which is due to you within 14 days from the day we receive the goods back.


For items returned which are not damaged faulty or mis-described:

If you are returning the items within 7 working days after delivery to your home or to AquaFish store, we will refund the price you paid for the item(s) and the original standard delivery charges (where applicable) in Pounds Sterling.

You will be refunded the cost of a standard delivery charge of the original outbound delivery cost.

You will be responsible for the cost of returning the items which are not damaged, faulty or mis-described, subject to any rights you have under your national consumer legislation.


For damaged, faulty or mis-described items:

If you are entitled to a refund on damaged, faulty or mis-described grounds, we will refund you as follows:

Any items from your order which are damaged, faulty or mis-described we will refund the cost of any damaged, faulty or mis-described items and any delivery charges, including the postage cost of returning these item(s).

You will be refunded the cost of a standard delivery charge. If you have paid for any premium delivery services, you shall not be entitled to a refund of the difference between the standard delivery cost and the premium delivery cost.

With the exception of damaged, faulty or mis-described items, delivery charges will not be refunded if you return only part of the order (e.g. you have ordered two items but only return one). 

This refund policy does not affect your statutory rights.


General

Our products are for personal use only and our liability shall not in any event include business losses such as lost data, lost profits or business interruption.

The above statement shall not limit or affect our liability resulting from any items sold being found to be unsafe or if something we do negligently causes death or personal injury. Our liability to you in connection with any order will not exceed the total price charged for the items, subject to any rights under your national consumer legislation.

You may not transfer any of your rights under these Aqua Fish Product Terms & Conditions to any other person. We may transfer our rights under these Aqua Fish Product Terms & Conditions to another business where we reasonably believe your rights will not be affected.

If you breach these Aqua Fish Product Terms & Conditions and we choose to ignore this, we will still be entitled to use our rights and remedies at a later date or in any other situation where you breach these Aqua Fish Product Terms & Conditions.

We shall not be responsible for any breach of these Aqua Fish Product Terms & Conditions caused by circumstances beyond our reasonable control. Except as expressly set out in these Aqua Fish Product Terms & Conditions, all use of your personal information will be made in accordance with our Privacy Policy.

These Aqua Fish Product Terms & Conditions are subject to English law and the non-exclusive jurisdiction of the English courts.

Recycling

Recycling electrical equipment

With effect from July 2007, the UK's Waste Electrical and Electronic Equipment (WEEE) Regulations require that all producers of electrical equipment are now obliged to pay for recycling of household electrical goods, where previously this bill was met by councils or items were not recycled at all. These regulations also require that all retailers both actively assist in delivering a UK wide WEEE collection infrastructure and encourage the participation of consumers in recycling electronic equipment.

So that you can get your waste electrical goods recycled, AquaFish have contributed towards a national fund to assist local councils to further develop their existing waste electronics collection facilities, which will in turn allow producers of this equipment to meet their obligations.

Not all council sites are suitable to collect all types of waste electrical goods but to find out your nearest participating site (including other collection facilities that may not be operated by the council) and for advice on all aspects of recycling at home, please visit www.recycle-more.co.uk Don't forget to have your postcode ready to use in the "recycling facilities" locator.

Electronic waste is one of the fastest growing waste streams and much of it can be recycled and resources recovered to make new consumer goods. To remind consumers of the collection methods available, which in turn allow recycling to take place, all electrical items sold now carry the crossed out wheeled bin symbol. Submitting Reviews

You may post reviews, comments and other content; send communications; and submit suggestions, ideas, comments, questions, or other information (together referred to as "Customer Reviews"), as long as the content is not illegal, obscene, abusive, threatening, defamatory, invasive of privacy, infringing of intellectual property rights, or otherwise injurious to third parties, or objectionable and does not consist of or contain software viruses, political campaigning, commercial solicitation, chain letters, mass mailings, or any form of "spam." You may not use a false e-mail address, impersonate any person or entity, or otherwise mislead as to the origin of any content.

AquaFish reserves the right (but not the obligation) to remove or edit any Customer Reviews to make them suitable for publication on www.aqua-fish.co.uk.

If you do post a Customer Review, and unless otherwise indicated by Aqua Fish, you:

grant Aqua Fish a non-exclusive, royalty-free and fully sublicensable rights to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such content throughout the world in any media; and
Aqua Fish and its sublicensees the right to use the name and location that you submit in connection with such Customer Review, if they choose.

You represent and warrant that you own or otherwise control all of the rights to the Customer Review that you post; that, as at the date that the Customer Review is submitted to Aqua Fish: (i) the Customer Review is accurate; (ii) use of the Customer Review you supply does not breach any applicable Aqua Fish policies or guidelines and will not cause injury to any person or entity. You agree to indemnify Aqua Fish for all claims brought by a third party against Aqua Fish arising out of or in connection with a breach of any of these warranties. Customer Reviews will be moderated and stored by a third party. The only information shared with the third party is that which you submit in your review (e.g. nickname, rating, review, location).
